Sivil Technologies, Inc. (“Sivil Technologies,” “we,” “us,” “our”) takes your privacy rights very seriously. Please review this Privacy Policy (our “Privacy Policy”) in conjunction with our Terms of Service (our “Terms”). Our Policy and our Terms collectively govern our provision to you of a variety of online and mobile platforms for engaging public sector organizations (our “Services”). By using our Services, you consent to our collection, storage, review, analysis, transfer, disclosure, duplication, and other use of your information. You acknowledge that by clicking “Join Now,” “Download,” “Sign Up,” or similar links, or otherwise registering, accessing, installing and/or otherwise using our Services, you are agreeing to our Terms (https://www.Sivil Technologies.io/termsofuse) and our Privacy Policy.

2. INFORMATION THAT SIVIL TECHNOLOGIES COLLECTS

We collect various kinds of personal information that you provide to us. Additionally, we automatically collect certain technical information when you use our Services. Here is a detailed list of information that we collect in connection with your use of our Services.

a. Your Registration Information. When you create an account with us or download our App, we collect information, such as your full name, your display name, physical address, email address, phone number, account password, geolocation, time zone, social media, profile picture and preferred language. Your display name, location and profile picture will be visible to others when you use the public functions within our Services.

b. Your Social Media Login. If we provide you the option to log in with a social media account, then we may collect your social media profile information, such as your name, profile picture, email address, a list of your contacts/friends/connections, and other information you make public through the social media platform.

WE ARE NOT RESPONSIBLE FOR THE PRIVACY POLICY OR TERMS OF USE OF ANY THIRD-PARTY SOCIAL MEDIA PLATFORM. We recommend that you review the social media platform’s privacy policy and terms of use and that you set your privacy preferences on the applicable social media platforms.

c. Data That You Post. We collect information that you provide to us about your engagement with public sector organizations. For example, we collect your written description of your engagement with public sector organizations, including your general summary of the event and any other text; the date and time of the event; the physical location of the event (which may be generated through geolocation services and/or your input); the people involved and a description of those people; and related photographs, graphics, images, video recordings, and audio recordings; tags; and other data (collectively, “Data”).

DUE TO THE NATURE OF OUR SERVICES, THE DATA THAT YOU POST WILL BE PUBLICLY AVAILABLE AND MAY BECOME AN OFFICIAL PUBLIC RECORD. PLEASE SEE SECTION 3(B) BELOW FOR MORE INFORMATION.

d. Your Financial Information. If you elect to pay for any part of our Services, then you will need to provide us with certain financial information, such as credit card information, payment app information or other online payment details. We may also collect and store your purchase history. If we use a third-party payment processor, you must become familiar with and abide by any terms of use and policies set forth by the third-party provider.

e. Your Customer Service Information. We collect information when you contact us for customer support. For example, if you contact us for customer service, we may need to access your account information, profile information, information we need to categorize and respond to your question, and, if applicable, information related to any alleged breach of our Terms or our Privacy Policy. We may use this information to track potential problems and trends and customize our support services to better serve you. We do not use this information for advertising.

f. Information About Your Computer and Mobile Device. We collect information from the devices and networks that you use to access our Services. For example, we receive the internet protocol (“IP”) address of your computer or the proxy server that you use to access the web, your computer operating system details, your web browser type and configuration, certain mobile device information (including your mobile device identifier provided by your mobile device operating system), your mobile operating system (if you are accessing our Services using a mobile device), and the name of your ISP or mobile carrier. When you visit or leave our Services (whether as a paid user or not) by clicking a hyperlink or when you view a third-party site that includes our plugin or cookies (or similar technology), we automatically receive referring URL information (i.e., the URL of the site from which you came or the one to which you are directed). Generally, we use information about your computer and/or mobile device for operating purposes, such as maintaining the security of our Services or reports and analysis to improve our Services.

g. Date, Time, and Location Information. We may collect and store information about the date and time you accessed our Services, made certain web browser requests, or posted Data or other content through our Services. We may also collect and store location data from third-party services or GPS-enabled devices that you have set up, which we may use to provide you with local information and/or for fraud prevention and security purposes.

h. Cookies. We use cookies and similar technologies to collect information. We use cookies and similar technologies, including mobile application identifiers, to help us recognize you across different Services, learn about your interests both on and off our Services, improve your experience, increase security, measure use and effectiveness of our Services, and serve advertising.

Please note that third party services may place cookies or similar technologies on your browser. We are not responsible for use of cookies by third parties.

i. Information about Our Messages to You (Web Beacons). We may place web beacons in emails or other messages that relay to you in order to collect information about when our messages were delivered to you and when you read, accessed or opened them.

j. Using Third-Party Services and Visiting Third-Party Site. We may collect information when you use your account to link to or log into third-party sites, and when you view web pages that include our plugins and cookies. We may use this information to permit us to post your content on additional platforms when you elect to do so or to recommend tailored content to you. We may provide reports containing aggregated impression information to companies hosting our plugins and similar technologies to help them measure traffic to their websites, without personal data.

k. General Information about Our Services. We collect and analyze general information about the use of our Services, such as the volume of users, location of users, types of content provided by users, and the ways in which individuals use our Services (e.g., which webpages or links they use). This information may sometimes be associated with specific IP addresses, accounts, or users. However, we may also cumulatively view and utilize this information.

3. HOW SIVIL TECHNOLOGIES USES INFORMATION IT COLLECTS

We use your information for legitimate business purposes, in compliance with our legal obligations, and/or with your consent. Here is a more detailed explanation of how we use your information.

a. Account Logon. If you link your account with a social media platform, then we will use the information collected from the platform to create your account with us and for your account logon in connection with our Services. 

b. Disclosure to the General Public and to Our Public Sector Clients. Your display name, location, and other profile information will be publicly available. As explained below, Data about your engagement with public sector organizations will be available to the general public. We also share this information with our public sector clients.

DUE TO THE NATURE OF OUR SERVICES, DATA ABOUT YOUR ENGAGEMENT WITH PUBLIC SECTOR ORGANIZATIONS WILL BE SHARED PUBLICLY AND WITH CERTAIN PUBLIC SECTOR ORGANIZATIONS. MEMBERS OF THE PUBLIC MAY COPY, DISTRIBUTE AND OTHERWISE SHARE YOUR DATA AND WE CANNOT CONTROL OR LIMIT HOW OTHERS MAY USE YOUR DATA. COPIES OF YOUR DATA MAY BE IMPOSSIBLE OR IMPRACTICAL TO REMOVE OR DELETE FROM THE PUBLIC SPHERE OR FROM OUR SYSTEM. ADDITIONALLY, CERTAIN DATA RELAYED TO PUBLIC SECTOR ORGANIZATIONS MAY BECOME SUBJECT TO VARIOUS PUBLIC RECORD LAWS, WHICH MEANS THAT THE PUBLIC SECTOR ORGANIZATION MAY BE LEGALLY REQUIRED TO DISCLOSE THE INFORMATION IN CERTAIN CIRCUMSTANCES. WE ASSUME NO CONTROL OR RESPONSIBILITY FOR USE OF YOUR DATA BY THE GENERAL PUBLIC OR BY PUBLIC SECTOR ORGANIZATIONS.

c. Our Business Operations. We may internally use information collected across all of our platforms to improve our Services and to conduct research and development for new features. We may also share non-private user information with third-party service providers as necessary to operate our systems, fight spam, improve our technology, upgrade security functions, and for similar purposes. By using our Services, you consent to our sharing of your non-private information with such third parties as reasonably necessary for our business operations.

d. With Your Consent or Request. We may share your personal information or your Data with your consent or in connection with your reasonable request.

e. Sharing Information with Third Parties. When using our Services, you may choose to click on external, third-party internet links, including links to social media platforms. Alternatively, a third-party provider may give you the option of uploading certain Data stored with us to the third-party’s platform. If you choose to share Data in this manner, you will be granting us permission to share the information with the third-party provider or granting the third-party provider the right to store, access and disclose the information in accordance with the third party’s terms and privacy policy. We are not responsible for and do not control any third-party providers, even if we provide links to their sites or share information with them at your request.

f. Legal Requirements and Similar Matters. In our sole discretion, we may access, use, preserve and disclose any information, including any Data that you provide to us, in order to: (i) comply with any law, regulation, governmental order, court order, subpoena or to otherwise comply with our legal obligations; (ii) enforce our Terms and/or our Privacy Policy, including investigation of possible or alleged violations of our Terms and/or Privacy Policy; (iii) investigate, prevent, or take action regarding suspected or actual illegal activities or to assist government enforcement agencies regarding such activities; (iv) investigate and defend ourselves against any third-party claims or allegations, (v) protect the security and integrity of our Services, detect and prevent fraud, and address technical issues; or (vi) exercise or protect the rights, property, or safety of Sivil Technologies, our users, and/or others.

g. Disclosures to Others as the Result of a Change in Control or Sale ofSivil Technologies. If we elect to purchase business assets or another company or any part of either, or if we choose to sell our business assets or the company or any part of either, then we may share your information with the third-party purchaser or third-party seller. Any third-party company subject to any such purchase and sale agreement will have the right to continue to use your personal information and other information, including Data, that you provide to us, subject to our Terms and our Privacy Policy. This provision also applies to sales and purchases with any of our subsidiaries, divisions, and affiliates.

4. Rights to Access, Correct, or Delete Your Information

You may access, correct, delete information in your account information at any time. You may also close your account at any time. However, Data that you upload, post, or otherwise make available through our Services may remain visible after you have closed your account or deleted the information from your own profile. Furthermore, you may not be able to access, correct, or eliminate any Data copied or exported out of our Services because this information may not be in our control.

5. Data Retention

We retain the personal information you provide while your account is in existence or as needed to provide you services. However, we may keep certain information even after you close your account if it is necessary to comply with our legal obligations, meet regulatory requirements, resolve disputes, prevent fraud and abuse, or enforce our Privacy Policy or our Terms. We may retain personal information for a specific period of time as requested by law enforcement.

Furthermore, we may maintain Data that you provide to us indefinitely. Moreover, as stated above, we relay such Data to applicable public sector organizations. Information provided to public sector organizations may become public records, requiring their disclosure to anyone who requests in accordance with applicable law. Finally, Data that you publicly disclosed through our Services may remain available to the public indefinitely.

6. OUR COMMUNICATIONS WITH YOU

We may communicate with you through various means, including email, text message and posts on our Services. Our communications may pertain to the availability of our Services, new features, your account, security issues, updates to our Terms or our Privacy Policy, or other service-related matters. These communications are a necessary part of our Services and by using our Services, you consent to communications from us. THEREFORE, PLEASE BE AWARE THAT YOU CANNOT OPT OUT OF RECEIVING SERVICE MESSAGES FROM US. These messages will be sent to you based on your profile and account information, as well as your messaging preferences. You may update your contact preferences at any time.

7. PHISHING WARNING

We will never text or email you to ask you for your display name, full name, account information, login information or password, financial information, or similar matters. Please be vigilant with respect to emails or messages that claim to be from Sivil Technologies and refer to suspicious activity or log-in attempts on your account, describe a problem with your account information or payment information, include an invoice or link to make a payment, or request other sensitive information. Such communications may be phishing attempts. Before replying to any such communication or clicking on any links or attachments, you can verify the communication is actually from us by calling customer service or sending the communication to hello@Sivil Technologies.io. You may also have the right to report phishing scams to various local and federal agencies. We also recommend that you use updated security software on all of your devices, require multi-factor authentication to access your accounts, and back up your data.

8. Third-Party ServiceS

As stated throughout this document, our Privacy Policy does not apply to third-party services, such as third-party websites, applications, platforms, or service providers, or to any third-party that we do not own, control, manage or direct. We do not take any responsibility whatsoever for the content, application, or enforcement of the privacy policies of any third parties, irrespective of whether such third-party service is accessible through our Services. You use any and all third-party services at your own risk and subject to the applicable third-party’s terms of use and privacy policy.

9. Advertising Technologies

In connection with our Services, you may receive advertisements through third-party networks. Those third-party advertising networks may collect information about you in an effort to present you with targeted ads. We are not responsible for third-party advertisements or your ability to opt out of such advertising.

10. Data Processing Outside Your Country 

We may collect, transfer, store, process, and/or analyze your content outside the country where you live. By using our Services, you agree that we may collect, store, process, and analyze your information outside your country of residence.

11. California’s Shine the Light Law

California Civil Code Section 1798.83-1798.84, known as the “Shine The Light” law, permits our customers who are California residents to request and obtain a list of what personal information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year and the names and addresses of those third parties. Under Section 1798.83, we currently do not share any personal information with third parties for their direct marketing purposes. However, if you are a California resident and would like a copy of an annual “Shine The Light” notice, then please submit a written request to Sivil Technologies, Inc., c/o Corporation Service Company, 251 Little Falls Drive, Wilmington, DE 19808.

12. PRIVACY OF MINORS

As stated in our Terms, our Services are intended for individuals who are at least fourteen (14) years old. We do not intend to collect information from individuals who are thirteen (13) years or younger. If you believe that a minor who is thirteen (13) years or younger is providing personal information to us, please contact us at hello@Sivil Technologies.io

Additionally, if you are less than eighteen (18) years old (or such different minimum required age to have authority to enter into a contract in your country), your parent or legal guardian must agreement to our Terms and our Privacy Policy on your behalf.

We encourage parents and legal guardians to direct their minor children to not provide personal data or identifying information to us without permission, and further encourage parents and legal guardians to monitor their children’s online activity for safety purposes.

13. Security; DATA BREACHES

We take privacy and security very seriously and have implemented security safeguards designed to protect your personal information in accordance with industry standards. We also regularly monitor our system for possible vulnerabilities and attacks. However, unfortunately, the internet is not a 100% secure environment, and we cannot ensure or warrant the security of any information that you transmit to us. There is no guarantee that information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. It is your responsibility to protect the security of your login information. Please note that emails, instant messaging, text messaging, and similar means of communication with others are not encrypted, and we strongly advise you not to communicate any confidential information through these means. Again, please help keep your account safe by using a strong password, protecting your password, logging off of your account immediately after use, and otherwise protecting your devices and your account from unauthorized use.

If you think that your account with us has been comprised, please contact us immediately at hello@Sivil Technologies.io. If we experience a data breach that results in unauthorized access to, or to collection, transmittal, transfer, use or disclosure of your personal information, then we will promptly investigate the event, notify you as required by applicable law and take any additional steps required by applicable law.

14. CHANGES TO OUR POLICY

We, in our sole and absolute discretion, may modify our Privacy Policy from time to time. We will notify users of any material changes to our Privacy Policy by reasonable means, such as by posting the updated version on our Website, our App and/or other applicable platforms. Unless stated otherwise, our current Privacy Policy applies to all information that we have about you and your account. Using our Services after a notice of changes has been communicated to you or published on our Services shall constitute consent to the changed terms or practices.

IF YOU OBJECT TO ANY CHANGES IN OUR PRIVACY POLICY, YOU MUST CLOSE YOUR ACCOUNT AND STOP USING OUR SERVICES.
